April 11, 2016
The Council and Officers of the City of Windy Hills met at the Sojourn Community Church, 2501 Rudy Lane, at 7:00 P.M. Mayor Ising called the meeting to order.

MINUTES:
Councilwoman Greer moved to approve the minutes of the March 14, 2016 regular council meeting; seconded by Councilwoman Davis and approved unanimously.
FINANCIAL REPORTS, APPROVAL OF BILLS:
The financial reports for March, 2016 were moved for approval by Councilwoman Rademaker, seconded by Councilwoman Davis and approved unanimously.
Councilman Skelton moved to approve the March bills, totaling $32,495.13 and was seconded by Councilwoman Davis. The motion passed unanimously.
RESIDENTS’ COMMENTS/CONCERNS: Greg Fleischaker, a resident on Bentwood Place, asked the Council if the City would consider doing the maintenance of their entrance, cutting grass, mulching, etc. The Council said they would have our contractor add it to his list of entrances to take care of.
Laura Trachtenberg, a resident, reported there was a sign in a tree along Rudy Lane, that states “Hillary for Prison”. It was determined that since it is on the right of way, it could be taken down. The Code Enforcement Officer will have the police department assist him.
COMMITTEE REPORTS:
Finance/Ordinances: Councilwoman Davis stated she is currently checking rates for CD’s.
Code Enforcement: Steve Teaford reported the expense to take care of the cleanup at 4320 Rudy Lane is $650 and asked the City Attorney to file a lien on the property.
Community Caring/Health & Fitness/Welcome to Windy Hills: Councilwoman Spencer reported there are 3 new residents and 3 new plaques plus a replacement for trees on the Green. Councilwoman Spencer made a motion to spend up to $100 to cover expenses of printing Emergency Preparedness booklets. The motion was seconded by Councilman Skelton and passed unanimously.
Community Events/Newsletter/Tree Board: Councilwoman Greer reported that there are two properties with dangerous trees and the Tree Board intends to write letters to the owners. She also stated that Arbor Day is Sunday and the give-away trees will not be there in time but the drawing will still be held with the trees available in the fall. There will also be a pruning demonstration. The 4th of July Picnic and Parade will be held at Sojourn with the food being served from the inside and the people in attendance sitting outside. She is going to reserve a tent(s) which have a 36 hour cancellation policy. She also stated the next newsletter deadline is May 20.
Public Works: Councilman Phillips reported the Windy Hills quadrant landscape at Westport R. and I-264, as well as the others at the Watterson Expressway has been updated by Brightside. He also reported that the free stack wall at Old Stone has been repaired. He reiterated that letters will be sent to the homeowners where there are damaged/dangerous trees.
Safety/Real Estate Signs: Councilwoman Rademaker read the report she had prepared and handed out to the Council. She stated that Graymoor-Devondale Police patrolled for 101 hours. 12.21 hours of this time was radar enforcement (12.0 on Ambridge and 21 minutes on Rudy) resulting in 19 warnings and 2 citations on Ambridge; 2 warnings and 2 citations were issued on Rudy Lane. No parking tickets were issued. An additional citation was issued on Ambridge for an expired tag and a traffic warning on Foeburn. Police dealt with an unfounded burglar alarm on Indian Ridge and assisted Metro police with an injury accident on Brownsboro Rd. Police dealt with a possible intoxicated person walking on Rudy Lane, who had had an accident and parked his car in the church lot. EMS transported him to Suburban Hospital, since he was having medical issues. There was a report of an unknown vehicle on Regency parked in the driveway of a vacant house, but police found no problems. Councilwoman Rademaker stated she would contact the chief concerning the fact that there is still very little radar enforcement on Rudy Lane, as well as total radar hours being far short of the requested amount of 20 hours. She would also address why there have been no parking violations issued. Councilwoman Spencer suggested having the Chief attend the next Council meeting or working session to address their concerns.
Windy Hills Green/City Beautification: Councilman Skelton reported that Brownsboro Landscaping had mulched and trimmed bushes. He also stated there was a tree down on the Green which Brownsboro Landscaping took care of and the sunken area on the Green was filled in by Diago Home Maintenance. He also reported there are now 239 Reach Alert members. Councilman Phillips asked if Arborist, Mike Hayman should be consulted for replacing the tree on the Green that had fallen down. Councilwoman Davis had printed off a LOGIC map of the Green stating that the map showed all the trees on the Green and the map could be used to show where the new trees are planted as well as labeled to show what type of tree was planted.
UNFINISHED BUSINESS:
Goal Setting for 2016: The Mayor stated that the Council had good conversations regarding the City’s 2016 Goals and would have monthly updates.
Fourth of July Celebration: Councilwoman Greer reported that the Picnic committee would have a meeting in the next month.
NEW BUSINESS:
Other: Councilwoman Spencer asked if the Senior Care Experts donation request would be put on the July agenda and be included in the budget. The money would be put in the budget and discussed at the next working session.
Councilman Skelton would like the Council to consider holding a Christmas in July to check the lights on the tree and get a head start on any repairs that might be needed. He would like to put up a banner announcing the Christmas in July. There will be no formal celebration. Councilwoman Rademaker made a motion to finance Christmas in July. The motion was seconded by Councilwoman Greer and passed unanimously.
ATTORNEY’S REPORT: Attorney Ritsert reported that she received notice that the foreclosure on the Lapp house has been dismissed. She also stated she has filed 6 liens for the remaining unpaid tax parcels. She will send a letter to each of the six regarding payment.
MAYOR’ REPORT: Mayor Ising thanked Martha Davis for her efforts for the City receiving the Tree City award for the second year. He also announced that Brightside Cleanup would be held on Saturday, April 16 at 9:00 am, meeting at Stock Yards Bank parking lot. He also reported that Sojourn Church continues to work on their parking issues.
Comments/Questions to the Council as a Whole: Martha Davis stated that it was very hard to hear the Council during the meeting due to the Music lessons that were going on at the same time as the meeting. Mayor Ising will inquire to see if the set up could be altered during the future meetings.
Councilman Phillips moved to adjourn the meeting at 7:57 P.M., seconded by Councilwoman Rademaker and the motion passed unanimously.

Councilwoman Greer moved to approve the minutes of the February 8, 2016 regular council meeting; seconded by Councilman Phillips and approved unanimously.
FINANCIAL REPORTS, APPROVAL OF BILLS:
The financial reports for February, 2016 were moved for approval by Councilman Skelton, seconded by Councilwoman Spencer and approved unanimously.
Councilwoman Rademaker moved to approve the February bills, totaling $43,007.27 and was seconded by Councilwoman Greer. The motion passed unanimously.
RESIDENTS’ COMMENTS/CONCERNS: Becky Ricketts with Senior Care Experts addressed the Council regarding the City’s annual donation. They have requested a $5,000 donation for 2016. Ms. Ricketts also offered use of their space for our Council Meetings if there was ever a space conflict with Sojourn.
COMMITTEE REPORTS:
Finance/Ordinances: No Report.
Code Enforcement: Steve Teaford reported he has been keeping on top of the vacant house at 4320 Rudy Lane. He also stated that he had the finalized Code Enforcement letter and would like the Council’s approval.
Community Caring/Health & Fitness/Welcome to Windy Hills: Councilwoman Spencer stated she has distributed 59 Emergency Contact Questionnaires and the Committee is working on an emergency plan for residents. Health and Fitness Committee arranged for a newsletter article regarding insect/mosquito repellants. She also stated there have been three additional memorial plaques requested. She also reported there were 9 home sales this month with fewer than half having moved in.
Community Events/Newsletter/Tree Board: Councilwoman Greer reported that the plans for the 4th of July look promising in regards to planning with the new Sojourn Community Church. She will be meeting with them after the Easter holiday. She also stated the next newsletter deadline is May 25 so the newsletter will be out in plenty of time for the 4th of July celebrations. Councilwoman Greer also reported that the Tree Board has met with and have an agreement with Otte Landscaping on Bardstown Rd., Wallitsch Nursery on Hikes Lane and Plant Kingdom on Westport Rd. for trees for the City. She stated the annual Windy Hills Arbor Day celebration will be on April 17 from 3-4:30 with an education program to feature a pruning demo.
Public Works: See New Business
Safety/Real Estate Signs: Councilwoman Rademaker read the report she had prepared and handed out to the Council. She stated that Graymoor-Devondale Police patrolled for 103.47 hours. 14.18 hours of this time was radar enforcement (12.9 on Ambridge and 1.39 on Rudy) resulting in 17 warnings and 2 citations on Ambridge; 1 warning and 4 citations were issued on Rudy Lane. No parking tickets were issued. A suspicious vehicle was reported on Ambridge near Rudy Ln. Burglar alarms went off on Indian Ridge and Coach Gate, both unfounded. One residence was on house watch. Officers assisted EMS with a case of heroin withdrawal and an overdose on Indian Ridge. They also took three minors home after being kicked off a TARC bus at Brownsboro and Rudy.
Windy Hills Green/City Beautification: No Report.
UNFINISHED BUSINESS:
Goal Setting for 2016: The Mayor stated that this would be further discussed in April.
Other: Councilman Skelton reported there are 215 Reach Alert members at this time.
NEW BUSINESS:
Fourth of July considerations: Mayor Ising stated he will know more at the Council meeting in April. He has received a letter from Sojourn and will meet with them after the Easter holiday.
Free Stack Walls and Trees: Councilman Phillips reported he had contacted Tom Johnson with Keystone Restorations and is waiting to hear back from him regarding the free stack stone wall on Old Stone Lane. Based on Council direction he will get estimates to make repairs in several areas where the wall has badly deteriorated for “free stack” without mortar and a repair using mortar that has the appearance of free stack. He will also try to find out if the wall is a landmark and if it is what kind of restoration is possible. Regarding the two decayed trees on the Green property line, Caroline Westfall, the City’s Arborist could send a letter to the homeowner to inform them of the declining trees.
ATTORNEY’S REPORT: Attorney Ritsert reported that she will be placing a lien on the properties that are delinquent in paying their property taxes.
MAYOR’ REPORT: Mayor Ising reported that the City has received the Tree City Designation again this year. He also stated that the Google services is still moving along. In addition, he mentioned that the parking situation at Sojourn is somewhat of a mess due to the weather, but Sojourn is trying to come up with a temporary solution. He also stated that Metro Louisville is working on a program to have just one contractor to supply recycling for all of Metro Louisville. He reminded all of the Council of the upcoming KLC City Officials Academy and to let the Clerk know if they would like to attend. Lastly, he reported that Tony Lindaur will be at the next JCLC meeting.

RESIDENTS’ COMMENTS/CONCERNS: None
COMMITTEE REPORTS:
Finance/Ordinances: Councilwoman Davis stated she may have a U of L Law Student Intern for the City to use in the future.
Code Enforcement: Steve Teaford reported he had nothing further than his written report. Councilman Skelton reported the house on Rudy Lane that looks abandoned is in the foreclosure process. It was also reported there are stakes on the Sojourn Church property where additional parking will be added.
Community Caring/Health & Fitness/Welcome to Windy Hills: Councilwoman Spencer stated she had nothing to report in regards to Health and Fitness. She reported that the Community Caring Team has 59 Emergency contact questionnaires to be updated by the residents who were new to the City in 2013/2014. She also reported her team will be meeting to discuss a potential “Disaster Plan” and would like to publish articles in the newsletters or have a handout. She reported that she is waiting on one plaque for the Ellerkamp tree. She stated she has added the new Code Enforcement Guidelines to the Welcome Packets. The City welcomed 7 new residents in January. She stated that the City’s demographics may be shifting per her observation of the new residents being younger in age. She also reported the City has had 59 new residents since January 1, 2015 and 54 total new residents for the years of 2013 and 2014.
Community Events/Newsletter/Tree Board: Councilwoman Greer reported that the next newsletter deadline is February 26. She also reported that the Grant that was prepared and submitted for the Tree Board by Cheri Silvey-Slusher was denied. She stated the Tree Board is planning an Arbor Day celebration for April.
Public Works: Councilman Phillips reported the City has received a building permit for a new house at 1002 Westgate and one for renovations for a house on Antrim. He also reported the Sojourn Church new entrance sign is up.
Safety/Real Estate Signs: Councilwoman Rademaker read the report she had prepared and handed out to the Council. She stated that Graymoor-Devondale Police patrolled for 103.46 hours. 13.38 hours of this time was radar enforcement (12.1 on Ambridge and 1.28 on Rudy) resulting in 7 warnings and 2 citations on Ambridge; 1 warning and 1 citation were issued on Rudy Lane. There was a traffic warning on Hubbards Lane at Pin Oak and a citation was issued on Indian Ridge for an expired tag. There was a parking warning on Victoria Place. Parked cars were also investigated on Bonfire and Victoria Place. Also reported were suspicious persons on Rudy at Ambridge and at Two Springs; 2 burglar alarms on Westgate; assistance with a motorist on Ambridge; three residences were on house watch.
Windy Hills Green/City Beautification: Councilman Skelton reported that Adam Vogelsang removed the green mold from all of the City’s white board fences.
UNFINISHED BUSINESS:
Ordinance No 4, Series 2015-2016 regarding Communications Services: Councilwoman Rademaker made a motion to have a summary first reading of Ordinance No. 4, Series 2015-2016 authorizing the Mayor to enter into a uniform franchise agreement relating to communications services. The motion was seconded by Councilwoman Davis and passed unanimously. Attorney Ritsert read the summary of Ordinance No. 4, Series 2015-2016 into record.
Goal Setting for 2016: Mayor Ising stated that Goal Setting was discussed at the Friday Working Session and would continue at the March working session. Councilwoman Rademaker suggested a goal for her to report on at the March Goal session.
NEW BUSINESS:
Delinquent Taxes: Attorney Ritsert stated that she will be sending out letters to the residents that are delinquent on their taxes.
ST. Matthews Fire Ambulance Service Resolution: Councilwoman Rademaker made a motion to approve Resolution No. 1, Series 2015-2016 in support of the Certificate of Need application of the St. Matthews Fire Protection District Holding Company, Inc. The motion was seconded by Councilwoman Greer and passed unanimously.
ATTORNEY’S REPORT: No report other than the property tax delinquent letters as stated above under New Business.
MAYOR’ REPORT: Mayor Ising reported that Sojourn church is progressing with their move into their new property and are addressing parking issues.

January 11, 2016
The Council and Officers of the City of Windy Hills met at the Calvin Presbyterian Church, 2501 Rudy Lane, at 7:00 P.M. Mayor Ising called the meeting to order.

MINUTES:
Councilwoman Greer moved to approve the minutes of the December 14, 2015 regular council meeting; seconded by Councilwoman Davis and approved unanimously.
FINANCIAL REPORTS, APPROVAL OF BILLS:
The financial reports for December, 2015 were moved for approval by Councilwoman Rademaker, seconded by Councilwoman Davis and approved unanimously.
Councilman Phillips moved to approve the December bills, totaling $54,177.47 and was seconded by Councilwoman Rademaker. The motion passed unanimously.
RESIDENTS’ COMMENTS/CONCERNS: Resident Martha Davis addressed the Council with three subjects/concerns: 1 – She handed out Financial Interest Statements to the Council and Staff; 2 – There is a barrel on Hubbards Lane that needs to be removed; 3 – She would like to see a street light put up at the corner of Hubbards and Rudy.
COMMITTEE REPORTS:
Finance/Ordinances: Councilwoman Davis stated she is checking on Money Market rates vs. CD rates.
Code Enforcement: Steve Teaford submitted the final Code Enforcement Guidelines which included all of the changes/suggestions made to him. He said the Council needs to decide how this will be distributed to the residents.
Community Caring/Health & Fitness/Welcome to Windy Hills: Councilwoman Spencer stated she had nothing to report in regards to Health and Fitness and Community Caring. She reported that there were four new residents and that the Christmas decorations were ready to be stored.
Community Events/Newsletter/Tree Board: Councilwoman Greer reported that the next newsletter deadline is February 26. She had nothing to report for the Tree Board as the meeting would be held later that week.
Public Works: Councilman Phillips reported there is a leaning yield sign at Jonlyn and Foeburn and Eagle Sign has been contacted to repair/replace it. Adam Vogelsang, the City’s snow removal contractor, reported that he plowed the westward facing hills and Magic salted all the roads.
Safety/Real Estate Signs: Councilwoman Rademaker stated she had not received the report from Graymoor/Devondale police. She said that when she called to inquire about the missing report she would ask Chief Throneberry to check on cars parked overnight on the streets.
Windy Hills Green/City Beautification: Councilman Skelton reported Mike Hayman, the City’s arborist for the Green, is attending a nursery tradeshow. The two suggested plantings for around the benches are; dwarf burning bushes and dwarf viburnuim. These could possibly take a long time to get.
UNFINISHED BUSINESS:
Reach Alert Program : Councilman Skelton reported that there have been 2 alerts sent out. Currently there are 162 users. He would like the City Clerk to send out another email blast to make the residents aware of this system. He also suggested that when an alert is sent out that the person sending out the alert should contact one other City Reach Alert Administrator to concur that the situation calls for an alert to be sent.
NEW BUSINESS:
Records Retention Activities: Councilman Phillips reported that he worked with Pam Howarah, Administrator with the KY Dept. for Libraries and Archives. She offered suggestions and guidelines for retaining the City records. She will check on the Codification Grant status.
Google Franchise Interlocal Cooperation Agreement and Municipal Order: Councilwoman Greer made a motion to approve Municipal Order #3, Series 2015-2016 in regards to a Google Franchise Interlocal Agreement. The motion was seconded by councilwoman Spencer and passed unanimously. Councilwoman Spencer made a motion to accept the Google Franchise Interlocal Cooperation Agreement and was seconded by Councilman Phillips. The motion passed unanimously.
Goal Setting: Mayor Ising stated the discussion on Goal Setting would continue at the February work session when the Council would decide how many Goals they would try to accomplish in 2016 and discuss in depth and determine the priority of each Goal.
ATTORNEY’S REPORT: Attorney Ritsert reported that the they had received notice in the Audrey Lapp case that there was a 60 day stay, which means nothing will happen until after 60 days. She also stated that in February she will be addressing the delinquent taxes.
MAYOR’ REPORT: Mayor Ising reported that Chief Seng will be at the February work session to explain the St. Matthews Ambulance Resolution regarding ambulance services in St. Matthews. Chief Seng will entertain questions at that meeting. Mayor Ising also stated he had received a call from a resident inquiring if the Henchy property (5-6 undeveloped acres) was going to be developed. He stated to his knowledge there was no activity or plans for development.
Comments/Questions to the Council as a Whole: Alan Ware inquired about the Google Municipal Order and Interlocal Agreement. Mayor Ising stated that, in summary, the City is agreeing to have Metro work on our behalf to negotiate with Google to bring a new, faster web service to Metro, which includes all 82 incorporated Cities within Metro.
Councilman Phillips moved to adjourn the meeting at 7:35 P.M., seconded by Councilwoman Rademaker and the motion passed unanimously.

Councilwoman Greer moved to approve the minutes of the January 14, 2019 Council meeting; seconded by Councilwoman Myers and approved unanimously.
FINANCIAL REPORTS, APPROVAL OF BILLS:
The financial reports for January, 2019 were moved for approval by Councilwoman Trachtenberg, and seconded by Councilman Blue, and approved unanimously.
Councilwoman Greer moved to approve the January bills, totaling $39,156.96 that was seconded by Councilwoman Trachtenberg. The motion passed unanimously.
RESIDENTS’ COMMENTS/CONCERNS: Resident, Ralph Williams, reported the there is hole on the north-east corner of Indian Ridge and Brownsboro Rd that needs to be fixed.
Resident, Faye Gardner – addressed the Council with a concern about a flooding issue on Highfield. Adam Vogelsang , Bruce Blue, and Steve Teaford will look at it and fix it.
Resident Rick Feldhof lives on Chelsea Rd adjacent to the Corn property. He expressed concerns about future traffic if the property were to be developed. Mayor Davis assured him that the City is keeping a close eye on it.
MAYOR’S REPORT: Mayor Davis stated that she and Councilwoman Rademaker attended the JCLC meeting that featured a presentation on Budgets. Going forward, she will prepare a written statement and read it at the 2nd reading of the Budget Ordinance. She also stated that we have been compliant with the required quarterly budget versus actual comparison. She also stated that it was encouraged for Cities to not permanently reduce the tax rate as it is difficult to return to a higher rate. It is preferred to offer a higher discount. She reported that Windy Hills tax rate is one of the lower rates. She also reported that she will open the bank statements to conform with controlling and auditing standards. During tax season, she will hold the bank statements for Councilwoman Rademaker to open and review. This will be done to insure compliance with proper financial controls.
She also reported that letters were sent to residents that reside close to 4417 Westport Rd. in regards to potential development. Numerous phone calls and emails were received regarding this. She has also contacted the Filson Historical Society to research the property.
She thanked the Council members, Jim Hodge, Steve Teaford, and Sandy Moore for their hard word in changing to the new email system, which will comply with the Open Records requirements.
She also reported that she has talked to the managers of Stock Yards Bank to see what the City’s options are in regards to receiving a higher interest rate on our checking account.
She has also contacted the Mayors of Indian Hills and Woodland Park regarding providing police service. She wants to make sure the City is getting the best “bang for our bucks” by using Graymoor/Devondale Police.
COMMITTEE REPORTS:
Finance/Ordinances: Councilwoman Rademaker reported that she has been learning a lot about the budget process and that the City will be streamlining accounts.
Code Enforcement: Steve Teaford, the City’s Code Enforcement Officer, reported that a lien was filed on the house at 1006 Chesham. #9 Pin Oak has not paid their fee at this time and Attorney Hodge will send them a letter. He also reported the rental letters have been mailed and the office has started receiving the fees.
Community Caring/Health & Fitness/Welcome to Windy Hills: There were 8 new residents. Councilwoman Spencer reported she will be sending out information regarding a place and times for the Tai Chi program.
Windy Hills Green/City Maintenance/Newsletter/Tree Board – Councilwoman Greer: Councilwoman Greer reported that the dead tree on the Green has been removed. She also reported that EchoTech is giving the City a tree. She said the next Tree Board meeting will be on February 21st. The newsletter deadline will be on February 22.
Public Works: Councilman Blue reported that Adam Vogelsang assisted with the cleanup on Merrifield. He also stated he will check out the reported hole on Indian Ridge and Brownsboro Rd. He reported that a manhole cover had been repaired and he thanked Adam for doing a great job with the snow removal – there were no phone calls/complaints received regarding the snow removal.
Ordinances/Community Standards – Councilwoman Trachtenberg: Councilwoman Trachtenberg reported that the Community Standards committee will be meeting again to continue to review.
UNFINISHED BUSINESS:
Waste Services Update – Councilwoman Myers: Councilwoman Myers reported that she is gathering information for the three public focus groups. She stated the contract ends in June. She also reported that the surveys were ready to mail out with the self addressed stamped envelope included. She received three estimates for the mailing. Councilwoman Myers made a motion to use “Mail Louisville” to mail the surveys and was seconded by Councilman Blue. The motion passed unanimously.

ATTORNEY’S REPORT: Attorney Hodge opened the Franchise Bid from Verizon on February 8, 2019 at 11:00 am. He is reviewing the bid and will get back to the City as to what the next action will be. Attorney Hodge stated that Ordinance No 6, Series 2018/2019 will be passed in March (regarding encroachment permits). He also stated he will mail a letter to the residents on PIn Oak that had not paid the initial fine agreed upon by the Council.
Comments/Questions to the Council as a Whole: Resident Allen Ware stated that Metro Louisville is considering increasing taxes and suggested that our residents check with their insurance companies to assure that Windy Hills will receive their proper portion of the taxes.

Councilwoman Greer moved to approve the minutes of the December 10, 2018 Council meeting; seconded by Councilwoman Trachtenberg and approved unanimously.

FINANCIAL REPORTS, APPROVAL OF BILLS:

Councilwoman Greer moved to approve the December bills, totaling $68,968.97 that was seconded by Councilwoman Trachtenberg. The motion passed unanimously.

COMMITTEE REPORTS:
Finance/Ordinances: Councilwoman Rademaker reported that she will be reviewing the budget in preparation of the 2019/2020 budget. She stated that one goal is to streamline the budget categories. Councilwoman Rademaker made a motion that all expenditures over $50 must have prior written approval from the Mayor or a designee. Forms to document such expenditures will be provided. Her motion was seconded by Councilwoman Greer and passed unanimously.
Code Enforcement: Steve Teaford, the City’s Code Enforcement Officer, reported that the house at 4320 Rudy Lane appears to be vacant. Some of the windows are broken. He will try to reach the owner to get the property brought up to code.
Community Caring/Health & Fitness/Welcome to Windy Hills: There were 4 new residents. Councilwoman Spencer reported she may plan a meet and great for the new residents. She also stated that the Aging in Place Committee will meet to update the materials in the Aging in Place binders to distribute at a later date.
Windy Hills Green/City Maintenance/Newsletter/Tree Board – Councilwoman Greer: Councilwoman Greer reported Mayor Davis had met with Mike Hayman to evaluate the trees on the Green. She stated they will be adding a new Zelkova as well as a tree at Westport & Foeburn entrance to replace a dead one. She stated the next newsletter deadline will be February 22.
Public Works: Councilman Blue thanked Councilman Phillips, Councilman Skelton and Code Enforcement Officer, Steve Teaford for all their help in setting up his job as the chair of Public Works.
Ordinances/Community Standards – Councilwoman Trachtenberg: Councilwoman Trachtenberg reported that the focus has been on Rental Houses and that the Community Standards Committee will be meeting to discuss their purpose and moving forward.
UNFINISHED BUSINESS:
Recycling Update – Councilwoman Myers: Councilwoman Myers presented a timeline for the Waste Services Contract process.
Tree Board Members: The two new tree board members appointed are: Jim Ising and Erin Morris. Councilwoman Greer made a motion to appoint these new members as per Memorandum of Agreement #1, Series 2018/2019 and was seconded by Councilwoman Trachtenberg. The motion passed unanimously.
Community Standards Members: Councilwoman Trachtenberg stated the Community Members appointed to this Committee are: David Volmer, Martha Davis, Steve Miller, Kate Greer, Martha Davis, Attorney Jim Hodge, and Code Enforcement Officer, Steve Teaford. Councilwoman Trachtenberg made a motion to approve Memorandum of Agreement #2, Series 2018/2019 to appoint these members. The motion was seconded by Councilwoman Rademaker and approved unanimously.
NEW BUSINESS:
Ordinance 6, Series 2018/2019 – regarding Driveway Regulations: Councilwoman Greer made a motion to have the Ordinance read into record and was seconded by Councilwoman Tractenberg. The motion was approve unanimously. Attorney Hodge read the summary, first reading into record. No further action taken.
Other: Code Enforcement Officer, Steve Teaford, stated the cleanup at Pin Oak has been accomplished. The Original fee was $1,150, but will impose only $200 of the fee if paid by the next meeting of February 11, 2019. The balance of the penalty of $950 will be suspended for 2 years on the condition the property is kept clean and after which the penalty will expire. Attorney Hodge will send a letter stating this to the homeowner.
ATTORNEY’S REPORT: No report.
MAYOR’S REPORT: Mayor Davis thanked everyone for coming and invited all to attend the Caucus meetings. She stated she welcomes and encourages input. Her report is summarized below:
- She talked to all Council Members regarding their role in the City and assigned the Committee Chairs – Marianne Rademaker – Mayor Pro tem, Finance , and Ice Cream Social Chair; Suzanne Spencer – Community Caring and “Buff and Fluff”; Kate Greer – Newsletter and City Maintenance including the Green, Tree Board Liaison; Bruce Blue – Public Works; Laura Trachtenberg – Ordinances and Community Standards Committee; Marcia Myers – July 4th Celebration, Newsletter Assistant, and will work on new communication avenues for the City including Facebook, etc.
- Recycling – Marcia and Bruce open forums
- Green Update – Met with Mike Hayman and Jim Ising to review the Green. Mike Hayman will remain as the Green Consultant and identified some trees that need care. He will work with Adam Volgelsang to take care of this. A water maple is dying and needs to be removed. Three trees will be planted – all on the original design.
- She will be handling Public Safety and working directly with Graymoor/Devondale. There was 8.2 hours of house watch, and motorist assistance and the rest of the time was devoted to radar and traffic control – resulting in 1 citation on Ambridge and 5 warnings on Rudy and Ambridge. We will be enforcing the overnight parking ordinance effective February 1 after notifying the residents.
- City hall hours are 10:00 am – 2:00 pm Monday through Friday. The hours will be posted on the office door and the City website. Marianne Rademaker has agreed to serve as Mayor Pro tem and has a key to the building and office.
- Ordinance Update – The City hired Mark Madison as consulting engineer who will be consulting on various ordinances including driveways, encroachment, etc. Community Standards Committee – City voted to create this committee to review and address our community standards. Marianne Rademaker and Kate Greer will serve for a 1 year carryover from the previous year’s committee. There will also be 4 Windy Hills residents on the committee.
- Chelsea Road – Surveying has been conducted at the property at 4417 Westport Rd – a cornfield at the end of Chelsea Rd. She is sending a letter to the property owner and residents asking for their help in monitoring the proposed development.

Code Enforcement: Steve Teaford, the City’s Code Enforcement Officer, reported that there have been 47 rental letters mailed and will start the inspection process of the rental properties in March.
Community Caring/Health & Fitness/Welcome to Windy Hills: There were 4 new residents. Councilwoman Spencer reported that she spoke with a woman that lives on Victoria and has Christmas decorating experience and has asked her to help in the future with the Windy Hills Christmas decorations.
Community Events/Newsletter/Tree Board: Councilwoman Greer stated the next newsletter deadline will be February 15. She reported that there will be two new Tree Board members to replace the two that have been elected to the City’s Council. These new board members will be approved at the January meeting.
Public Works: Councilman Phillips reported there was a catch basin sinking on Two Springs that he has reported to MSD.
Police Liaison/Real Estate Signs: Councilwoman Rademaker reviewed the report from November, 2018. She stated the Graymoor/Devondale Police patrolled the City over 100 hours. Eleven hours of radar time was spent on Ambridge, resulting in two citations and six warnings. Eight hours of radar time was spend on Rudy which resulted in two citations and one warning. Officers assisted motorists on Kitty Hawk and Ambridge. Home watches were in effect on Highfield, Indian Ridge, Chelsea and Grassy Fork.. Two parking citations were issued on Clerkenwell. A suspicious person was reported on Ambridge, but not located by police. Also reported was a possible identity theft, open fire at a construction site, a shooting, and possible overdose.
Windy Hills Green/City Beautification: No report.
UNFINISHED BUSINESS:
Annual Audit: Councilwoman Greer made a motion to accept the corrected Audit for 2017/2018 that was seconded by Councilwoman Davis. The motion passed unanimously.
Communications Franchise Update – Attorney Hodge stated the City needs to advertise for the bid.
Code of Ordinance Codification update from American Legal Publishing Corp.: City Clerk, Sandy Moore, reported that the last two ordinances will be forwarded to American Legal for publishing.
Oath of Office – Monday, December 31, 2018 – 1:00 pm – City Hall: There will be a Special Meeting notice posted for December 31.
Other: The Rudy Lane and Ambridge intersection has been approved by Metro and Safe-T-Co will be doing the work to install flexible yellow posts and move the sign.

MAYOR’S REPORT: Mayor Ising stated that this is his last meeting as Mayor and thanked everyone for their service to the City. He also thanked Councilman Phillips and Councilman Skelton for their combined 35 years of service. He stated that they would be available to help the new members. He congratulated the new Mayor and members.
Comments/Questions to the Council as a Whole: Resident, Ralph Williams reported that there is a big hole on the east side of Indian Ridge at Brownsboro Rd.

RESIDENTS’ COMMENTS/CONCERNS: Resident Kevin Middleton at the corner of Indian Ridge and Kitty Hawk (616 Indian Ridge) stated he would like to build and place a Little Free Library on his property. Code Enforcement Officer, Steve Teaford, told him it would have to be 15 feet in from the street. He would like for the City to invest the money to build this and will get back to the Council when he is ready to build it. He also addressed the recycle program, stating that he would really like once a week recycle pick up.

Code Enforcement: Steve Teaford, the City’s Code Enforcement Officer, reported that the dead tree on Ambridge has been taken care of; the shrubs at Rudy and Ambridge have been cut back. He also stated that he has 2 open issues he is currently working on to resolve – one is at 1006 Chesham (a lien has been filed) and #9 Pin Oak (hopes the issue will be resolved soon).
Community Caring/Health & Fitness/Welcome to Windy Hills: No report.
Community Events/Newsletter/Tree Board: Councilwoman Greer stated the next newsletter deadline will be November 12. She stated the Glow on the Green will be held the Sunday after Thanksgiving, November 25.
Public Works: Councilman Phillips reported the work at Brownsboro Rd and Rudy Lane has been finished as well as the repair work on the Windsong sidewalk and Deerfield curb.
Police Liaison/Real Estate Signs: Councilwoman Rademaker reviewed the reports from September and October, 2018. She stated the Graymoor/Devondale Police patrolled the City over the 100 hours each month. The majority of radar time was spent on Ambridge resulting in two citations, four warnings and one arrest for speeding and fleeing the police. They also had radar on Rudy Lane resulting in resulting in two citations and two warnings. There were house watches and business checks in September and October. There was one parking warning on Clerkenwell and two citations issued on Pin Oak for a driveway being blocked. Other miscellaneous items reported were suspicious persons (unfounded), theft on Bonfire, possible bicycle theft, theft from an unlocked truck (Greenbriar)and garage (Kinglan), returned a found checkbook and a stolen backpack.
Windy Hills Green/City Beautification: Councilman Skelton reported that the Verizon poles have been removed from the Green.
UNFINISHED BUSINESS:
Vote on 1 Trash, 1 Recycle, and 1 Yard Waste per Week: Councilman Phillips made a motion to have one trash, one recycle, and one yard waste pickup per week to be effective January 1, 2019. The motion was seconded by Councilman Skelton. Councilman Phillips stated this would be in effect until the new contract would be bid. He stated by doing this, it would save the City $9,600. He also stated the results of the survey, that was sent out to residents, was that the majority preferred one recycle, one trash, and one yard waste pickup per week. He reported that residents could purchase a larger bin on wheels for about $20 and he would be responsible for getting the notice out to all residents. After a long discussion, Councilman Phillips called the question and was seconded by Councilman Skelton. The vote on the original motion ensued with the following vote:

The Mayor broke the tie with an Nay vote, therefore the motion failed.
Code of Ordinance Codification update from American Legal Publishing Corp.: City Clerk, Sandy Moore, reported that she had filed for an extension, which had been granted.
Other: Councilman Phillips made a motion to award The Healing Place with $1,250 contribution, stating the Council had previously awarded them with $1,250 (one-half of the requested amount). The motion was seconded by Councilwoman Rademaker and passed with the following vote:

NEW BUSINESS:
Annual Audit: Debbie Stumler, one of the City’s Auditors presented the 2017/2018 Audit Review. After reviewing the Audit, she stated the City is in good financial position, and they found no problems. She did report in the Independent Auditors Report that there were weaknesses that are common with all small Cities. One of the findings is because of only having one employee that handles all of the office duties, there is a lack of separation of duties. She stated that the Council is used to mitigate this issue. She also stated the City is not able to prepare the Financial Statements Report – for the same reason. She reported that this is reported every year and knowing this in advance, they perform more tests. Councilman Skelton presented his list of questions regarding the Audit. Ms. Stumler stated she would take the Audit back and review the questions and get back with the Council after her further review. The Audit was not voted on.
Repeal of Ordinances: Councilwoman Greer made a motion to have Ordinance #4, Series 2018/2019 to Repeal Ordinances no longer needed read into record for first reading. The motion was seconded by Councilwoman Davis and passed unanimously. Attorney Hodge read Ordinance #4, Series 2018/2019 relating to the Repeal of Ordinances into record. No further action was needed.
Other: Councilman Skelton made a motion to add yellow plastic lane dividers at the intersection of Ambridge and Rudy subject to the approval of Metro and traffic codes (not to exceed $1,500). His motion was seconded by Councilwoman Rademaker. Councilman Skelton stated that if someone hit these lane dividers they would bounce back and would not damage a car if driven over. He also stated it would eliminate the need to have Metro replace the sign constantly due to vehicles hitting the sign and knocking it down. The motion passed with the following vote:

Minutes of Regular Council Meeting
October 8, 2018
The Council and Officers of the City of Windy Hills met at the Sojourn Community Church, 2501 Rudy Lane, at 7:00 P.M. Mayor Ising called the meeting to order.

MINUTES:
Councilwoman Greer moved to approve the minutes of the September 10, 2018 Council meeting; seconded by Councilman Phillips and approved unanimously.
FINANCIAL REPORTS, APPROVAL OF BILLS:
The financial reports for September, 2018 were moved for approval by Councilwoman Davis, and seconded by Councilman Skelton and approved unanimously.
Councilwoman Davis moved to approve the September bills, totaling $110,312.83 and was seconded by Councilwoman Spencer. The motion passed unanimously.
RESIDENTS’ COMMENTS/CONCERNS: Residents, Bill and Brandy Norton addressed the Council stating that they support the City wide Recycle program. They suggested weekly pickup and trash twice weekly is unnecessary. They would like to have tops to the recycle bins so everything would be contained in them.
COMMITTEE REPORTS:
Finance/Ordinances: Councilwoman Davis read the report she had previously handed out to the Council. She reported that she attended the KY League of Cities Conference, focusing on the finance/legal workshops. She stated that if a contractor bills the City for work done that the City collects reimbursement from the resident that we have to file the sales tax the contractor has to charge. The City will, therefore, have to open up a sales tax account and report those monies collected. She also stated that she learned that Metro is rewriting their rental and temporary rental ordinances changing their passive registrations to a required registration (similar to ours). She also reported that she and Steve Teaford, our Code Enforcement Officer attended Graymoor/Devondale’s City Council Meeting to request authorization to join the ordinance appeals board. There is a resolution to this subject up for vote later in the meeting.
Code Enforcement: Steve Teaford, the City’s Code Enforcement Officer, reported that the property at #9 Pin Oak has accumulated a fine of $1,150 due to a junk issue. He has spoken to our Attorney, Jim Hodge, who has recommended that the City invoke a partial penalty of $200 and $950 balance if they do not comply with the Ordinance for two years. Councilwoman Greer made a motion to have the residents at #9 Pin Oak to pay a $200 (due now) and $950 if they do not comply with the Ordinance for the next two years. The motion was seconded by Councilwoman Davis and passed unanimously. Attorney Hodge will write a letter to the residents to inform them of this decision. Mr. Teaford also reported that the rental property at 1006 Chesham Rd. has not made the required repairs to the property for it to be within our City Codes. Councilman Phillips made a motion to file a lien on the property at 1006 Chesham Rd. and was seconded by Councilwoman Davis. The motion passed unanimously. Attorney Hodge will file the lien and forward a copy to City Hall for our records. Mr. Teaford also reported on the property at 606 Southview that is not in compliance with the Metro Ordinance regarding driveway widths. Councilwoman Greer made a motion to have the property owner at 606 Southview reduce his driveway to 26 ft as per Metro Ordinance and was seconded by Councilwoman Davis. The motion passed with the following vote:

Being a tie, Mayor Ising vote Aye. Attorney Hodge will write a letter to the resident at 606 Southview to inform him that he must reduce the width of his driveway.
Community Caring/Health & Fitness/Welcome to Windy Hills: Councilwoman Spencer reported that there are 5 new residents. She stated that the Tai-Chi portion of the Ice Cream Social (make up) had to be cancelled due to previous commitments. She hopes to have the program on a future date. She also stated that there are two new plaques installed on the Green.
Community Events/Newsletter/Tree Board: Councilwoman Greer stated the next newsletter deadline will be November 11. She stated that the Arbor Day/Ice Cream Social celebration had to be postponed one week due to rain. She said she would print the scavenger hunt answers, as everyone had a difficult time finding the items. She also reported that the Glow on the Green will be held on November 25.
Public Works: Councilman Phillips reported the work was finished to repair sidewalks and curbs and he reported that Wilson Farms and Greenhouse is the company that will repair the landscaping from the work LG&E did at the Signature Entrance at Rudy Lane and Brownsboro Rd. at no cost to the City.
Police Liaison/Real Estate Signs: No Report.
Windy Hills Green/City Beautification: Councilman Skelton reported that the fence post at Foeburn and Westport Road has been removed.
UNFINISHED BUSINESS:
Recycling Update: Councilman Phillips suggested that the Council vote on how long to continue the trial before making recycling permanent. Councilwoman Greer made a motion to have the City wide recycling every other Wednesday through this Fiscal Year (June 30, 2019), at which time a new contract will be specified and bid. Councilwoman Davis seconded the motion and passed unanimously. Councilwoman Davis asked the Council to include in the records that she is and has been in favor of Recycling because some residents thought she was opposed.
Communications Service Franchise Ordinance, Ord #2, Series 2018-2019: Councilwoman Greer made a motion for Attorney Hodge to have the second reading of Ord. #2, Series 2018-2019. Her motion was seconded by Councilwoman Davis and passed unanimously. Attorney Hodge proceeded with the second reading summary of Ordinance #2, Series 2018-2019. Councilwoman Davis made a motion to adopt Ordinance #2, Series 2108-2019 and was seconded by Councilwoman Spencer. The motion passed with the following vote:

Code Enforcement Board Participation: Councilwoman Greer made a motion to accept Resolution #2, Series 2018-2109 regarding the City having representation at the Graymoor/Devondale Ordinance Appeals Board. The motion was seconded by Councilwoman Davis and passed unanimously.
Code of Ordinance Codification update from American Legal Publishing Corp.: Councilwoman Greer made a motion to have a Special Meeting on October 23, 2018 at 1:00 pm for the purpose of the Council to review the Codification Book. The motion was seconded by Councilwoman Davis and passed unanimously.
Rental Ordinance Ordinance #1, Series 2018-2019 Second Reading: Councilwoman Greer made a motion for Attorney Hodge to have the second reading of Ord. #1, Series 2018-2019. Her motion was seconded by Councilwoman Davis and passed unanimously. Attorney Hodge proceeded with the second reading summary of Ordinance #1, Series 2018-2019. Councilwoman Davis made a motion to adopt Ordinance #1, Series 2108-2019 and was seconded by Councilman Phillips. The motion passed with the following vote:

NEW BUSINESS:
Rudy Lane Bench: Councilwoman Greer made a motion to have a bench similar to the other benches throughout the City to honor the outgoing Mayor, Jim Ising placed on Rudy Lane near the Kirkwood Glen Development. Her motion was seconded by Councilman Skelton and passed unanimously.
Other: Councilman Skelton would like to add two items to the website (under Frequently Asked Questions) – an additional paragraph regarding repaving or changing your driveway in relation to the Right of Way and add the permit form that includes the additional verbiage that 3 feet wide wings on each side of the drive in addition to the maximum driveway width and also add under “What City ordinances/regulations are most likely to affect my life” this verbiage: “These are exclusive of any Metro Regulations affecting your use.”
ATTORNEY’S REPORT: No report.
MAYOR’S REPORT: Mayor Ising stated the Brightside cleanup will be Saturday, October 20, 2018 at 9 am, meeting at the Stock Yard Bank parking lot. He also stated that the Audit review will be at the November meeting with our Auditors presenting the Audit. He reported that all candidates running for City Office must have “Paid for by” on their advertisements. He reported that he attended the September JCLC meeting with Sen. Ernie Harris and Rep. Jerry Miller presenting on the topic of transportation issues. He encouraged the Council to attend these meetings as they are a great learning opportunity. Mayor Ising also stated that River Fields is having a tour of the Edwards-Herr House Grounds on Sunday, November 4 at 1:30 pm and the cost is $25 for non-members. He wished all good luck in the upcoming elections.
