CITY OF WINDY HILLS
Minutes of Regular Council Meeting
September 11, 2017

The Council and Officers of the City of Windy Hills met at the Sojourn Community Church, 2501 Rudy Lane, at 7:00 P.M. Mayor Ising called the meeting to order.

MINUTES:

Councilman Phillips moved to approve the minutes of the August 14, 2017 Council meeting; seconded by Councilwoman Spencer and approved unanimously.

FINANCIAL REPORTS, APPROVAL OF BILLS:

The financial reports for August, 2017 were moved for approval by Councilwoman Davis, seconded by Councilman Skelton and approved unanimously.

Councilwoman Rademaker moved to approve the August bills, totaling $64,259.61 and was seconded by Councilwoman Davis. The motion passed unanimously.

PRESENTATION OF AUDIT AND APPROVAL: Debbie Stumler presented the 2016/2017 Audit to the Council reviewing portions of it. She reported that they found no problems and the City’s net worth is $1,125,913. Councilwoman Rademaker made a motion to approve the 2016/2017 audit and was seconded by Councilwoman Davis. The 2016/2017 Audit was approved unanimously.

RESIDENTS’ COMMENTS/CONCERNS: None

COMMITTEE REPORTS:

Finance/Ordinances: Councilwoman Davis reported that she and Steve Teaford are working on a revised Rental Ordinance.

Code Enforcement: Steve Teaford reported that there are still 17 properties in question as to whether they are rental properties or not. He has sent letters to these 17 property owners.

Community Caring/Health & Fitness/Welcome to Windy Hills: Councilwoman Spencer reported that she will have 50 Green booklets to hand out at the Ice Cream Social. She had no report for Health and Fitness and reported there are seven new residents in the City. She asked if anyone would be willing to share some of their magnolia tree limbs for the Christmas decorations. She also stated the committee will probably fluff the existing bows.

Community Events/Newsletter/Tree Board: No Report

Public Works: Councilman Phillips reported that Old Stone Lane had been opened up by having the trees and bushes trimmed to make it more accessible for Waste Management. He also reported that he is working on getting more information about the ROW permit for Foeburn and Westport.

Police Liaison/Real Estate Signs: Councilwoman Rademaker reported that Graymoor-Devondale Police Department patrolled Windy Hills for 103.2 hours. 15 hours of radar time was spent on Ambridge resulting in no citations and 4 warnings. Rudy lane received 3 hours of radar time, resulting in no citations and 4 warnings. A parking violation on Foeburn received a warning and a violation on Indian Ridge got cited. Two residences were on house watch and were checked numerous times. Suspicious persons were reported at Sojourn Church, but it was AC repairmen. Two noise complaints on Wicklow were investigated, turned out to be an electronic bird deterrent. A loud party was reported on Two Springs, but police found nothing. Criminal mischief was reported on Rudy Lane as well as a suspicious vehicle being reported but unfounded.

Windy Hills Green/City Beautification: Councilman Skelton reported that Rudy II would be put in place on Tuesday, Sept. 12, weather permitting. Councilwoman Rademaker made a motion to spend an additional $300 on the landscaping at Regency Lane and was seconded by Councilwoman Davis. The motion passed unanimously.

UNFINISHED BUSINESS:

Website Update: Councilwoman Davis stated she had contacted Kathleen Sauer with Lumins Assoc. who stated she was working on two other websites and would contact the City the last week of September to start working on the City’s new website.

NEW BUSINESS

Approval of 2016/2017 Audit: See above report by Debbie Stumler.

Addition of “No Parking Here to Corner” Signs on Ambridge near Westport Rd.: Councilman Skelton made a motion to have “No Parking Here to Corner” signs on each side of Ambridge, 2 houses back from Westport. The motion was seconded by Councilwoman Spencer. Attorney Hodge stated the City will need an Ordinance. The motion was tabled until the October meeting when Attorney Hodge will have the first reading of the Ordiance.

Playground Equipment at Sojourn: Councilman Phillips stated the playground equipment at Sojourn could be transferred to Sojourn with a clause that the City residents will have perpetual use. Mayor Ising reported that Sojourn likes the idea and may want to wait until after they expand to take ownership at which time they will relocate the equipment. Attorney Hodge stated he will draw up an agreement, declaring the equipment as surplus property and give to them.

ATTORNEY’S REPORT: Attorney Hodge reported that the Right of Way Encroachment permit needed a formal process. Councilwoman Davis made a motion that the City adopt a formal process regarding Encroachment Right of Way permits. The motion was seconded by Councilwoman Rademaker. Attorney Hodge stated he drew up a Resolution regarding the Right of Way Encroachment Permit and application. Attorney Hodge read Resolution #1, Series 2017/2018 into record. Councilwoman Davis and Councilwoman Rademaker withdrew their original motion. Councilwoman Davis made a motion to approve Resolution #1, Series 2017-2018 regarding the Right of Way Encroachment application and permit. The motion was seconded by Councilwoman Rademaker and passed unanimously.

Attorney Hodge also addressed the Telecom Tax lawsuit, stated that the City now has the privilege of accepting Telecom Tax or Franchise Fee – whichever is better. He will have more information on this at the October meeting.

MAYOR’S REPORT: Mayor Ising stated that Metro Councilwoman Angela Leet (Leet with Lemonade) will be at the Ice Cream Social. He also stated he will be on vacation from September 25 through September 29.

COMMENTS/QUESTIONS TO THE COUNCIL AS A WHOLE: Resident, Martha Davis, stated the trashcan on the Green was full on Sunday.

Councilwoman Davis moved to adjourn the meeting at 7:50 P.M., seconded by Councilman Phillips and the motion passed unanimously.
