Minutes of Regular Council Meeting

November 12, 2018

The Council and Officers of the City of Windy Hills met at the Sojourn Community Church, 2501 Rudy Lane, at 7:00 P.M.  Mayor Ising called the meeting to order.

The Mayor introduced individually all the new and current Councilmembers  as well as the new Mayor and congratulated each one for winning the election.  He also thanked Councilman Phillips and Skelton (who did not run for re-election) for their years of work and service to the City.

MINUTES:

Councilwoman Greer moved to approve the minutes of the October 8, 2018 Council meeting; seconded by Councilman Phillips and approved unanimously.  Councilwoman Davis moved to approve the minutes of the October 23, 2018 Special Council meeting; seconded by Councilman Skelton and approved unanimously.

FINANCIAL REPORTS, APPROVAL OF BILLS:

The financial reports for October, 2018 were moved for approval by Councilman Skelton, and seconded by Councilwoman Davis and approved unanimously.

Councilwoman  Rademaker moved to approve the October bills, totaling $44,054.05 and was seconded by Councilwoman Davis.  The motion passed unanimously.  (Councilman Phillips pointed out that there were 22 tax refunds made in October.)

RESIDENTS’ COMMENTS/CONCERNS:  Resident Kevin Middleton at the corner of Indian Ridge and Kitty Hawk (616 Indian Ridge) stated he would like to build and place a Little Free Library on his property.  Code Enforcement Officer, Steve Teaford, told him it would have to be 15 feet in from the street.  He would like for the City to invest the money to build this and will get back to the Council when he is ready to build it.  He also addressed the recycle program, stating that he would really like once a week recycle pick up.

COMMITTEE REPORTS:

Finance/Ordinances:  No report.

Code Enforcement:  Steve Teaford, the City’s Code Enforcement Officer, reported that the dead tree on Ambridge has been taken care of; the shrubs at Rudy and Ambridge have been cut back.  He also stated that he has 2 open issues he is currently working on to resolve – one is at 1006 Chesham (a lien has been filed) and #9 Pin Oak (hopes the issue will be resolved soon).

Community Caring/Health & Fitness/Welcome to Windy Hills:   No report.

Community Events/Newsletter/Tree Board:   Councilwoman Greer stated the next newsletter deadline will be November 12.  She stated the Glow on the Green will be held the Sunday after Thanksgiving, November 25.

Public Works:  Councilman Phillips reported the work at Brownsboro Rd and Rudy Lane has been finished as well as the repair work on the Windsong sidewalk and Deerfield curb.

Police Liaison/Real Estate Signs:  Councilwoman Rademaker reviewed the reports from September and October, 2018.  She stated the Graymoor/Devondale Police patrolled the City over the 100 hours each month.  The majority of radar time was spent on Ambridge resulting in two citations, four warnings and one arrest for speeding and fleeing the police.  They also had radar on Rudy Lane resulting in resulting in two citations and two warnings.  There were house watches and business checks in September and October.  There was one parking warning on Clerkenwell and two citations issued on Pin Oak for a driveway being blocked.  Other miscellaneous items reported were suspicious persons (unfounded), theft on Bonfire, possible bicycle theft, theft from an unlocked truck (Greenbriar)and garage (Kinglan), returned a found checkbook and a stolen backpack.

Windy Hills Green/City Beautification:  Councilman Skelton reported that the Verizon poles have been removed from the Green.

UNFINISHED BUSINESS:

 Vote on 1 Trash, 1 Recycle, and 1 Yard Waste per Week:  Councilman Phillips made a motion to have one trash, one recycle, and one yard waste pickup per week to be effective January 1, 2019.  The motion was seconded by Councilman Skelton.  Councilman Phillips stated this would be in effect until the new contract would be bid.  He stated by doing this, it would save the City $9,600.  He also stated the results of the survey, that was sent out to residents, was that the majority preferred one recycle, one trash, and one yard waste pickup per week.  He reported that residents could purchase a larger bin on wheels for about $20 and he would be responsible for getting the notice out to all residents.  After a long discussion, Councilman Phillips called the question and was seconded by Councilman Skelton.  The vote on the original motion ensued with the following vote:

The Mayor broke the tie with an Nay vote, therefore the motion failed.

Code of Ordinance Codification update from American Legal Publishing Corp.:  City Clerk, Sandy Moore, reported that she had filed for an extension, which had been granted.

Other:  Councilman Phillips made a motion to award The Healing Place with $1,250 contribution, stating the Council had previously awarded them with $1,250 (one-half of the requested amount).  The motion was seconded by Councilwoman Rademaker and passed with the following vote:

NEW BUSINESS:

Annual Audit:  Debbie Stumler, one of the City’s Auditors presented the 2017/2018 Audit Review.  After reviewing the Audit, she stated the City is in good financial position, and they found no problems.  She did report in the Independent Auditors Report that there were weaknesses that are common with all small Cities.  One of the findings is because of only having one employee that handles all of the office duties, there is a lack of separation of duties.  She stated that the Council is used to mitigate this issue.  She also stated the City is not able to prepare the Financial Statements Report – for the same reason.  She reported that this is reported every year and knowing this in advance, they perform more tests.  Councilman Skelton presented his list of questions regarding the Audit.  Ms. Stumler stated she would take the Audit back and review the questions and get back with the Council after her further review.  The Audit was not voted on.

Repeal of Ordinances:  Councilwoman Greer made a motion to have Ordinance #4, Series 2018/2019  to Repeal Ordinances no longer needed read into record for first reading.  The motion was seconded by Councilwoman Davis and passed unanimously.  Attorney Hodge read Ordinance #4, Series 2018/2019 relating to the Repeal of Ordinances into record.  No further action was needed.

Other:  Councilman Skelton made a motion to add yellow plastic lane dividers at the intersection of Ambridge and Rudy subject to the approval of Metro and traffic codes (not to exceed $1,500).  His motion was seconded by Councilwoman Rademaker.  Councilman Skelton stated that if someone hit these lane dividers they would bounce back and would not damage a car if driven over.  He also stated it would eliminate the need to have Metro replace the sign constantly due to vehicles hitting the sign and knocking it down.  The motion passed with the following vote:

ATTORNEY’S REPORT:  No report.

MAYOR’S REPORT:  Mayor Ising stated there would be training for the new Council members and encouraged all the new members to sign up for this training.  He also stated the City had received a “Thank You” from Volunteers of America for the City’s donation.

Councilwoman Greer moved to adjourn the meeting at 8:26 P.M., seconded by Councilman Phillips and the motion passed unanimously.
