Minutes of Regular Council Meeting

September 10, 2018

The Council and Officers of the City of Windy Hills met at the Sojourn Community Church, 2501 Rudy Lane, at 7:00 P.M.  Mayor Ising called the meeting to order.

MINUTES:

Councilwoman Greer moved to approve the minutes of the August 13, 2018 Council meeting; seconded by Councilman Skelton and approved unanimously.

FINANCIAL REPORTS, APPROVAL OF BILLS:

The financial reports for August, 2018 were moved for approval by Councilwoman Rademaker, and seconded by Councilman Phillips and approved unanimously.

Councilwoman  Davis moved to approve the August bills, totaling $44,276.34 and was seconded by Councilwoman Skelton.  The motion passed unanimously.

RESIDENTS’ COMMENTS/CONCERNS:  Resident, Tish Moore addressed the Council and asked for them to continue to support/offer recycling in the City.

COMMITTEE REPORTS:

Finance/Ordinances:  No report.

Code Enforcement:  Councilman Phillips asked Mr. Teaford to highlight some of the “hot spots” in the City.  He reported the #9 Pin Oak was an area he is working on – junk issue.  Another area he is working on is 4326 Rudy Lane – abandoned cars issue.  He also stated there are two rentals that failed inspection that he is working on getting cleared up.

Community Caring/Health & Fitness/Welcome to Windy Hills:   Councilwoman Spencer reported that there are 9 new residents.  She stated that she and Suzanne Ronniger will have signup sheets and handing out information at the Ice Cream Social regarding a Tai Chi program.

Community Events/Newsletter/Tree Board:   Councilwoman Greer stated the next newsletter deadline will be November 11.  The  delayed Arbor Day celebration will be included with the Ice Cream Social on September 23.  Also included at the Ice Cream Social will be records shredding and information regarding Tai Chi.  Glow on the Green will be held on November 25.  She also reported the Tree Board has developed their 2018/2019 work plan.

Public Works:  Councilman Phillips reported the wash out on Brownsboro Road by Coach Gate has been cleaned up.  He also stated a resident called about his house flooding on Rudy Lane and asked what the City could do.  After some research, Councilman Phillips told the resident his house is in the flood plain and would be his responsibility.  He also reported a tree at Rudy and Foeburn was trimmed and is waiting to meet with Metro regarding the intersection at Rudy and Ambridge.

Police Liaison/Real Estate Signs:  Councilwoman Rademaker read the report she had previously distributed.  She stated that Graymoor/Devondale Police Department patrolled Windy Hills for 114.2 hours. 1.0 hour of radar time was spent on Ambridge.  Rudy Lane received about 19.0 hours of radar time, resulting in four citations and four warnings.  An abandoned car with expired tags was towed on Ambridge. House watches were in effect on Highfield, Chelsea, Tottenham and Grassy Fork.  Parking citations were given on Highfield, Tottenham (2) and Ambridge.  Warnings were issued on Bonfire, Clerkenwell, Taxham Ct., and Windhurst.  A complaint about parking on Ambridge proved to be unfounded.  A suspicious vehicle was stopped at Sojourn Church with juveniles with a small amount of marijuana…parents were called.  An intoxicated person was found in a car parked on Rudy Lane….parents were called.  A missing 15 year old was located hiding in a closet on Foeburn.  Two suspicious persons walking around on Tottenham were checked.  They also had three business checks at Brownsboro Center and an unfounded burglar alarm on Brownsboro Rd.

Windy Hills Green/City Beautification:  Councilman Skelton reported Brownsboro Lawn Care replaced the four dead bushes at the Wexford Place entrance and he has also cleaned up the entrance at Foeburn and Westport Rd., with the exception of one fence pole with utilities connected to it.  That will be completed in the near future.

UNFINISHED BUSINESS:

Recycling Update:  Councilman Phillips reported that there seems to be a great interest in recycling from the participation that has been observed

Communications Service Franchise Ordinance, Ord #2, Series 2018-2019:  Councilwoman Greer made a motion for Attorney Hodge to have the first reading of Ord. #2, Series 2018-2019.  Her motion was seconded by Councilwoman Davis and passed unanimously.  Attorney Hodge proceeded with the first reading summary of Ordinance #2, Series 2018-2019.  No further action needed.

Code Enforcement Board Participation:  Attorney Hodge reported that the Council has proposed for Windy Hills to join local enforcement instead of taking cases to Circuit Court.  He stated Graymoor/Devondale has to approve our City joining this group.  Their meetings are held on the 3rd Tuesday of the month at 6:30.  Councilwoman Davis plans to attend this month along with Code Enforcement Officer Steve Teaford and possibly Attorney Hodge if he can make it.

Code of Ordinance Codification update from American Legal Publishing Corp.:  Clerk Moore stated that the draft Code of Ordinances Codification has been received.  Mayor Ising had passed out a time line of what will take place and in what order.  It appears the Codification is on schedule and will be completed soon.

NEW BUSINESS:

Revised Rental Ordinance #1, Series 2018-2019, first reading:  Attorney Hodge stated that the revision of the Ordinance is to add regulations for short term rentals, such as Air B and B.  Councilwoman made a motion to have the first reading and was seconded by Councilwoman Davis.  The motion was approved unanimously.  Attorney Hodge proceeded to read the summary of Ordinance #1, Series 2018-2019 into record.  No further action necessary.

Election 2018:  Mayor Ising stated that candidates will have the opportunity to expand their bio’s and have them published on the City’s web page.  The dead line for these bio’s is October 15, 2018.

ATTORNEY’S REPORT:  No report.

MAYOR’S REPORT:  Mayor Ising stated that there will be a program put on by KLC and JCLC for newly elected officials and encouraged all that are elected to attend one of these sessions.

Comments/Questions to the Council as a Whole:  Mike Luebeach, a resident, recommended that the Coach Gate residents be given a large rolling can for recycling.  Most of the residents are elderly and  that would be helpful for them.

Councilwoman Greer moved to adjourn the meeting at 7:48 P.M., seconded by Councilwoman Rademaker and the motion passed unanimously.
