A meeting of the Windy Hills Tree Board was held on Thursday, December, 2013, 4:00 P.M. at Commonwealth Bank & Trust Company, 286 N. Hubbards Lane. A meeting of the Tree Board was not held in November due to there not being a quorum present. Martha reserved our meeting room at Commonwealth for 2014 for the following dates: January 2, February 6, March 6, April 3, May 8, June 5, July 10, August 7, September 4, October 2, November 6 and December 4.

Minutes: The minutes of the meeting held on October 3, 2013 were approved.
Financial Report: Allan submitted the following financial information for the Tree Board account and Arborist account: Tree Board account – $7,914.23 and Arborist account, $3,320.75.
City Council Report: John and Alison Schech of 708 Wicklow Road, bought an October Glory Maple through the City’s residential tree program. $18,000 has been raised to date through the matching grant offer of an anonymous donor. This money will be used for the planting of trees and placement of benches on Windy Hills Green as well as defining and mulching the pathway.
Nominating Committee: As of January 1, 2014 there will be two vacancies on the Tree Board as Leland and Terese’s one year terms are complete. With the approval of the Tree Board members, Martha and Cheryl will compose a Nominating Committee to bring recommendations to the Board of two members who will fill 3-year terms.

Tree City USA Application: Dan has completed the Tree City application and after some minor tweaks it will be presented to the Mayor f.or his signature and sent off for consideration to the State Urban Forestry Coordinator.

Minutes: The minutes of the meeting held on September 5, 2013 were approved.
Financial Report: Allan submitted the following financial information for the Tree Board account and Arborist account: Tree Board account – $6,707.63 and Arborist account, $3,508.25.
City Council Report: Donations are being accepted for matching funds to be used on Windy Hills Green. $5,000 must be raised by December 1st from Windy Hills residents in order to receive the matching grant. After discussion it was decided that the Tree Board will not make a donation as a group, but may make personal donations. The Smiley modified plan which includes the identification and potential spots for the planting of trees will be viewed by council members at their working meeting on October 11th. Mike Hayman, with Martha Davis’s help, labeled the trees on the Smiley plan.
Tree Ordinance Revised Recommendations: Proposed revisions to the Windy Hills Tree Ordinance were discussed. The Tree Board approved revisions to the following sections of the Tree Board Ordinance: 5.d. City Planting of Street Trees; and 10. Public Nuisance Trees and Shrubs. a. and b.

Walk at Whitehall: A flyer was passed around that will be sent to all residents in a blast e-mail. Flyers will also be placed in neighboring businesses advertising the event.
Job List for Board Members:
Amy Carter will chair our November meeting in Martha’s absence. Terese will also be absent.
Arbor Day, Amy Carter will coordinate the event for 2014.
Windy Hills newsletter, Winter edition, Leland will prepare an article and will also prepare monthly educational e-blast message to be sent by the city clerk to all residents.
Allan Atherton will work on a video that can be used at different events.

Financial Report: Allan submitted the following financial information for the Tree Board account and Arborist account: Tree Board account as of 9/5/13 – $6,325.98 and Arborist account as of 9/5/13 – $3,508.25.
Arborist Report: Mike Hayman has asked to take a leave of absence effective immediately until January 1, 2014. The Metro Tree Commission has a budget of $250,000 for the planting of trees throughout the City on the right-of-ways, and Mike has the responsibility of determining the sites for the trees. Discussion was held regarding the need for a substitute arborist until Mike’s return, and Martha will investigate some options.
Tree Ordinance Revised Recommendations: Proposed revisions to the Windy Hills Tree Ordinance were discussed. The Tree Board approved revisions to the following sections of the Tree Board Ordinance: 3. i Review by City Council, Right to Appeal; 5 c City Tree Planting Program for Residents; 6 b Notice to Remove Tree or Shrub; 6 c Replacement of Removed Street Tree; 8 a Stump Removal; 10 a Public Nuisance Trees and Shrubs; 10b; 11 Enforcement A new section, 5 g, Site Selection for New Trees, was distributed to the Tree Board for discussion at our next meeting.

WH City Council Priorities/Windy Hills Green: The priorities as approved by the City Council were discussed – outline pathway, establish water source, plant canopy trees, landscape south side of property, fence along Rudy Lane and Brownsboro Road.
Updates: Walking tour of Whitehall will take place at 1:00 on Sunday, October 20, led by Mike Hayman. Terese reported that Lawnco has taken over the watering of newly planted trees;

Martha asked Allan to find out from Sandy Moore, City Clerk/Treasurer, the amount of money the City has spent in the past, per year, for the resident tree program and to average that amount out.
Procedures: Lynn Renau’s service on the Tree Board was terminated, and a new member to serve out an unexpired 1-1/2 year term will need to be selected. Martha distributed “Procedures for Selecting Tree Board Members” that was discussed and accepted. Cheryl will ask the City Clerk to send out a blast e-mail to all residents on Monday, July 15. Terese suggested that a notice asking for new members be placed in all quarterly City newsletters and that an open list of interested volunteers be kept for future reference. New tree locations for planting were discussed which included Westport Road at Foeburn, a second tree at Indian Ridge and Brownsboro Road, Chelsea, Bentwood Place Court, Windy Hills Green, Foeburn Lane. Martha distributed a “Process for Windy Hills Tree Board in Making Recommendations to the Windy
Hills Mayor and City Council for Site Selection and Planting of Trees”. This process was discussed at length, and Allan suggested that it be made part of Section 5 of the Windy Hills Tree Ordinance. All members agreed to the adoption of this process.
“Procedure for getting bids” was distributed and discussed. This procedure will not be used every time when asking for bids and will be up to the judgment of the person or entity asking for the bid. When seeking bids, it is necessary that all bidders use the same criteria.
Arborist Report: Mike was recertified after passing his test. This certification is good for three years.
The first tree planted by the Tree Board, an “Ogon Dawn Redwood, was planted within the right-of-way at Indian Ridge and Brownsboro Road. There is space, also within the right-of-way, for another tree to be planted. Three white “Natchez” crape myrtles will be planted behind the signature entrance at Foeburn and Westport Road. Mike will check the placement of the right-of-way and make suggestions of tree species for Bentwood Place Court. Bob Ray Company completed their work on Windy Hills Green.
Work Plan for 2013-14: Potential tree planting sites were discussed as well as preparing an annual work plan to be presented and approved by the Windy Hills Council. The Tree Board hosting a “Walking Tour of White Hall” on the 3rd Sunday in October was discussed in hopes of stirring up interest and educating residents.
Martha will send via e-mail draft revisions to the Windy Hills Tree Ordinance and asked all members to be prepared to discuss at our next meeting.

The minutes of the meeting held on May 9, 2013 were approved as corrected.
Allan reported the Tree Board account has a balance of $3,884.98 and the balance in the Arborist account is $1,670.75.
The Windy Hills Tree Ordinance was reviewed and suggested revisions were made to several sections. Allan will draft the revisions and the revised Ordinance will be presented to the Council for approval at a future date.
Policy suggestions regarding the Tree Board budget and City arborist budget as suggested by memo from Mayor Lou Phillips dated 5/28/13 were discussed and accepted. Discussion was also held on “who pays for what” – Windy Hills Tree Board budget or the City of Windy Hills. A memo from Councilman Ising dated June 3, 2013 regarding planting canopy trees was discussed as well as Mike Hayman’s response dated June 5th. It was noted that the Tree Board’s function is only to make recommendations, and it’s the Council’s decision to accept the recommendations or not. Martha, Mike and John Moore, a resident of Windhurst, met with two residents on Ambridge Drive and explained they had another opportunity to have ornamental trees planted in the right-of-way in front of their

homes. Wayne and Maureen Friedman agreed to have three “Ivory Silk” lilac trees planted, and Tom and Terry Grant agreed to have two or three trees planted if they were not redbud trees. It was noted there are two Persian Parrotia trees in the right-of-way at 1200 and 1201 Ambridge Drive that are in decline and should be replaced. Other residents along Ambridge Drive will be contacted to offer the planting of additional trees along the right-of-way.
Windy Hills Green: Metro arborist, Mark White, evaluated the trees on Windy Hills Green at Rudy Lane and estimates for the recommended work to be done were received from the Bob Ray Company, Greenhaven Tree Care, Limbwalker Tree Service and T’s Trees. After review and discussion of the estimates, Mike recommended that the Bob Ray Company be awarded the contract and asked that a certified arborist from the Bob Ray Company be on site when the work begins. Mike would also like to meet with them. It was highly recommended that beds of mulch be put around groups of trees to protect the roots.
The site where it was suggested we plant six October Glory maple trees at Foeburn and Westport Road is full of utilities and would need soil remediation. Mike believes another option would be to plant the trees further back on Foeburn which would be on David Lee’s, Donnie Wallace and Sammy Lee’s property. Mike has spoken to David Lee and Donnie Wallace and they are amenable to this proposal.
Mike expects to hear back from David Lee who is contacting the Highway Dept. to determine the feasibility of planting trees on Westport Road at Foeburn.
Mike will sit for his re-certification test next week in Lexington.
Leland has agreed to be our “Tree Champion”. He will prepare a flyer with bullet points for the care and maintenance of trees and will be willing to talk to homeowners who have questions. We also will have a Tree Board table at the 4th of July annual picnic and will wear our shirts and nametags to promote the planting and care of trees.

The minutes of the meeting held on April 4, 2013 were approved. The current balance in the Tree Board Account is $3,884.98 and the balance in the Arborist account is $912.50.
Evaluation of the Arbor Day event was discussed, and everyone agreed that it was a very successful event. Leland’s pictures of Arbor Day will be sent to the City to be added to the City’s website. The tree planting video was not sufficiently instructional to add to the website. It was decided to buy a second banner and 20 yard signs to advertise the event for next year. Choosing a date to celebrate Arbor Day, 2014 will be done well in advance so as not to coincide with Jefferson County school’s Spring Break or the Easter holiday.
Dan attended a meeting of the Windsong Neighborhood Association. They requested to have free trees planted in their neighborhood. Discussion was held and it was agreed there is a need for trees in Windsong, but at this time the Tree Board’s priority is planting trees in the most visible spots in the City. The Tree Board will send a letter to Mary Rita McDevitt, President of the Windsong Neighborhood Association, explaining our decision.
Discussion was held to create a Work Plan for the balance of the fiscal year. Opinions were voiced and a consensus was reached for the planting of canopy trees listed according to priority:
1. Open area on Westport Road at the entrance to Foeburn Lane, the opposite side from the entrance sign.
2. At the corner of Indian Ridge and Brownsboro Road near the entrance fence and landscape plantings, on the Christ Methodist Church side.
3. Ambridge Drive
4. Add canopy trees and ornamentals on Windy Hills Green once a decision on a plan has been reached.
The balance of allotted funds would be used for the purchase of quality trees, delivery of said trees, professional planting and mulching, contracted watering and long-term maintenance and professional pruning. This is based on the availability of specific trees and necessary soil tests.

Approval of Minutes: The minutes of the meeting held on March 7, 2013 were approved. A statement will be added at the end of the minutes asking for corrections/additions, and if none are received in five (5) days, the minutes will be considered approved as written.

Arbor Day, Sunday, April 7, 2012, 3:00 P.M.:
Promotion: The banner was installed on Windy Hills Green on Monday, April 1st by Councilman Mike Skelton who will also remove it after the Arbor Day celebration. Two “blast” e-mails were sent to all Windy Hills residents announcing Arbor Day and there was an article in the current Windy Hills newsletter.
Refreshments: Tables will be provided by Brownsboro Hardware and will be set up Saturday evening. Tree Board members were asked to bring 2-3 dozen cookies and additional refreshments will be provided by the Windy Hills Garden Club.
Registration: Members of the Windy Hills Garden Club will take registrations for the tree give away. Trees are to be given only to residents of Windy Hills.

Tree City USA: Dan reported on the status of the Tree City USA application which will be submitted at the end of this year. The three requirements have been met – tree ordinance, budget and proclamation for Arbor Day. At our next meeting in May, Dan will discuss allocation of funds and categories of expenses.
Tree Ordinance Proposed Revision: Allan distributed a proposed revision to 6.c Replacement of Removed Street Tree The revisions are in bold.
At the owner’s request, the City will replace contribute to the cost of replacing a problematic Street Tree as described in Paragraph 6.a, after the tree and stump have been removed by the owner at their expense. And will pay for both The City contribution will be for the tree and a qualified arborist to transplant it, up to a limit of $300. The owner shall pay any cost over $300. To qualify for the City contribution, The owner must choose a “Large” tree (i.e. a canopy tree) that is on the “Windy Hills Street Tree Listing of Trees Acceptable for Planting”, and that is approved by the City Arborist for the location.
Leland moved to accept the revision of 6.c Replacement of Removed Street Tree of the Windy Hills Tree Ordinance, seconded by Terese and unanimously approved. The revision will be presented to the Windy Hills Council at a later date when it is certain no more revisions are needed to the Ordinance.

Dan researched several cities’ tree ordinances regarding the removal of trees by residents and the need for permission from the city to do so. He will look at the City of Indian Hills’ tree ordinance to determine what restrictions, if any, they have.
2013 Work Plan:
Arborist Report: Mike drove with Allan and Lynn around Windy Hills to familiarize himself with the city. Mike thinks it is important to pursue a conservation easement for the Green to protect the land. Lynn will contact Mimi Runyon to determine the best way to pursue obtaining a conservation easement. Mike also said he would like to get some trees planted this Spring on the Green, such as a variety of deciduous magnolias, along with a simultaneous planting of canopy trees. The installation of a wood chip path was discussed, and Dan will research ADA requirements. Mike is meeting with John Swintosky, RLA the landscape architect with Metro Parks for his ideas and feedback. It was suggested that an evaluation of the trees on Rudy Lane be conducted, and Martha said she would contact Mark White, the Metro arborist.
Other: A disclaimer has been placed on our LOJIC map stating the tree coverage is inaccurate and it is a 2009 version. It was suggested that a monthly article regarding the maintenance and benefits of canopy trees be sent via e-mail to all residents from the Tree Board. Mike said the article should contain beautiful pictures with good advice. The Urban Design Studio is asking for volunteers to help map Louisville’s downtown tree canopy on Sunday, April 14, 1:00 PM, 507 S. Third Street.

Arbor Day Update: Mike has ordered 21 5-gallon container size/4’-5’ tall bur/white oak trees, including shipping, which totals $543.75 with a shipping date of April 1. Mike and Robert Rollins will determine the best location to plant a tree on Windy Hills Green. Cheryl reported she had been in touch with SignARama and that a 3’ x 10’ banner to be placed on Windy Hills Green would cost $180.00. Metal stakes that were used for Glow on the Green will be used and Mike Skelton will install the banner on Monday, April 1. Windy Hills”. Martha will purchase a $100 gift certificate from Henry’s Place for Robert and Patti Rollins. Leland will videotape the tree planting demonstration for future use and have it placed on the City of Windy Hills website. Martha will order green T-shirts with white lettering for Board members. Name tags were suggested and approved with the T-shirt logo on them. Refreshments and registration for the tree drawing will be handled by the Windy Hills Garden Club. Lynn will have a separate long table with the LOGIC map, proper planting brochures, WHHAG information and sign up for tree inventory survey training. Board member job assignments will be made at the April meeting.
Tree City USA: Dan reported he is keeping on pace with the requirements for qualifications. Allan suggested that Dan join TCUSA as our representative.
Updates and Follow-Ups: Lynn bought and brought in a 2009 version of the LOGIC map of Windy Hills. She will get it laminated to a backing so it is more portable and easily displayed.
The letter sent to 4324 Rudy Lane is not the owner of the tree specified in the letter. The letter will go from Louisville Metro arborist to 4326 Rudy Lane regarding the vines on the tree. A letter was sent to Mr. and Mrs. Oliva about their tree on Windsong Way. The tree will be removed by the homeowner and neighbors by April 11, 2013.
A tree survey training by Peter Barber, Div. of Forestry, will be scheduled after we have recruited interested volunteers. Allan and Leland will develop questions for Peter Barber as to how to convert the tree inventory information into multi-use data resources.
2012 Work Plan: Mike would like to be more familiar with the whole area of Windy Hills. Lynn and Allan will arrange to drive Mike around the city and all of its side streets. Mike will then be better prepared to help us develop a work plan for 2013.

WINDY HILLS TREE BOARD
FEBRUARY 7, 2013
A meeting of the Windy Hills Tree Board was held on Thursday, February 7, 2013, 4:00 P.M. at Eclipse Bank, 3827 Shelbyville Road.

Welcome: Martha opened the meeting with a welcome and thanks to Eclipse Bank for making their conference room available to us. Agendas were distributed.
Approval of Minutes: The minutes of the meeting held on January 4, 2012 were approved as written.
Budget Until 6-30-13: The line item of $5,000 for the Tree Board in the City of Windy Hills budget was acknowledged.
Replacement of Board Member: Candidates to fill the vacancy of Audrey Larkin were interviewed and provided with copies of the Tree Ordinance. Four residents expressed interest in joining the Tree Board. Leland Kessler, a new resident of Windy Hills and who lives on Rudy Lane, was nominated and will be recommended to Mayor Phillips for appointment with the approval of the Windy Hills Council. His term will be for one year and will commence upon appointment. Cheryl suggested that a procedure be put into place to cover future vacancies on the Board. It was suggested that a questionnaire for future candidates be developed. Cheryl will create a questionnaire similar to the original one used when seeking volunteers for the Tree Board and will bring before the Board for approval.
Arbor Day Update: Arbor Day will be held on Sunday, April 7, 2013, 3:00 P.M. on Windy Hills Green.
Cheryl will price a banner to be placed on the Green advertising Arbor Day. The Spring newsletter and blast e-mails to all residents will notify residents of the event and the free tree give-away.
A “historic” signature tree will be identified by Lynn and Mike and twenty, five-gallon trees will be given away through a drawing to Windy Hills residents who are present at the event.
Terese will contact Forest Keeling or Woody Warehouse to find the best price and shipping of the trees.
Terese will contact Robert Rollins, of Greenhaven, and ask him to demonstrate the proper planting of a tree. One of the “historic” signature trees will be planted on the Green.
Mike will price tree guards to be given away with each tree.
Cheryl will prepare the wording of a proclamation for the Mayor to read at Arbor Day.
Martha will ask Audrey Larkin and Lauri Holder to be in charge of refreshments for the event.
Educational hand-outs will be given with each tree, possibly stating “Windy Hills, A City of Historic Trees”.
Update and Follow Up: The tree on Windsong Way that should be removed is the property of the residents of 6100 Windrow Place as identified by Bob Rosenbaum. This situation is addressed in 6B of the Tree Ordinance. A form letter will be created to send to the resident and for future use. A tree at 4324 Rudy Lane was inspected by Mark White, Louisville Metro Arborist, and he sent a letter to the owners on January 22, 2013. The residents have ten days to call with questions and 30 days to remedy the situation. The tree is covered with heavy vines which is addressed in 8C of the Tree Ordinance. Again a form letter will be created to send to residents pertaining to remedying this. Terese suggested that a section of the Tree ordinance be published in our quarterly newsletters pertinent to the responsibilities of homeowners.
Beautification Locations A map of the City of Windy Hills was distributed.
Lynn was authorized to purchase a current LOGIC map for our future use in determining where and what kind of trees to plant.
It was suggested that the eight homeowners on Ambridge who chose not to have a tree planted on their property be given a second chance so that Ambridge will have a full tree canopy.
We will have a brainstorming session at our next meeting to determine priorities and focus for the year.

The first meeting of the Windy Hills Tree Board was held on January 4 , 2013 at 4:00 P .M. at the home of Martha Davis, 613 Rudy Lane.

Agendas were distributed as well as rosters of members and introductions were made.
Secretary: Cheryl volunteered for the job as Secretary .
Monthly Meeting: It was decided to hold the monthly meeting on the first Thursday of the month at 4 : 00 P .M. at members ‘ homes
on a rotating basis. The next meeting, February 7th, will again be held at Martha’s home .
Approval of Arborist : Mike Hayman had been a certified arborist , but his certification has lapsed. He will look into getting recertified in order to qualify as the arborist for Windy Hills .
Assignments :
Arbor Day : According to Mike Hayman , Forest Keeling of Missouri furnishes the trees for Metro Parks and the Olmsted and it would be to our advantage to “piggybacku on one of their shipments of trees in order to minimize freight costs. Terese will contact Forest Keeling to find out when their next shipment will be . We would like to offer 20 free trees to our residents on Arbor Day. Once Terese finds out the shipment details, we will then determine a date to hold Arbor Day in Windy Hills. We also will plan an educational seminar to go along with Arbor
Day.
Tree City USA Designation : Dan will oversee all the requirements of the application .
Windy Hills Annual Tree Work Plan : In discussing a tree inventory , Mike suggested that the most visible parts of the city be identified for our first tree inventory . All members of the Tree Board are asked to d~ive and/or walk throughout the city and make note of what spots are the most visible , such as the three signature entrances corners , etc .
A picture of a problem tree in Windsong that was brought before the Windy Hills Council was shown , and it was the recommendation of Mike that after identifying the property owner that the tree should be removed and the owners offered another tree to be planted in a better place using the City’ s tree subsidy program.
Announcements: The Metro Tree Commission meets on the third Tuesday of the month , 5 : 00 P .M. at the Air Pollution Control District conference room, 810 Barret Avenue , and it was thought to be beneficial for us to at end.
The KY Tree Board Seminar will be held on February 22nd at the Clifton Center and several members are planning to attend .
